If you have any questions about this Privacy Policy or our data practices, please contact us at privacy@ezbackyard.com or call us at (858) 630-6767.
This Privacy Policy applies to information we collect online through our websites, landing pages, and forms; offline when you interact with our team by phone or in person; and in connection with scheduling, installation, financing inquiries, and support. It does not apply to third‑party websites, services, or products that we do not control, even if they link to or from our sites. If you purchase products from third‑party retailers (e.g., Amazon, Home Depot) and engage us only for installation, those retailers’ privacy practices apply to your purchase and account with them.
We disclose PI to Service Providers under contracts that limit their use to providing services for us, including: website hosting, analytics, advertising, payment processing, financing partners, customer support, delivery logistics, and warranty administration. We may also disclose PI to professional advisors (attorneys, accountants), government authorities when required, successors in the event of a merger or asset transfer, and to other parties with your direction.
We use cookies, pixels, tags, and local storage to operate and improve the site, remember preferences, analyze traffic, and present relevant ads. Third‑party analytics (e.g., Google Analytics) provide aggregated insight into site usage. Advertising partners may set cookies to measure conversions and show interest‑based ads. You can manage cookies via your browser settings and our cookie banner (where available). If you use Global Privacy Control (GPC), we will treat it as an opt‑out signal for sale/ sharing where required by law.
We do not sell PI for money. In jurisdictions where the use of advertising cookies/pixels may constitute a “sale” or “sharing” under law, we honor opt‑out choices through our cookie banner and recognized user‑enabled signals (such as GPC). You may opt out of such activities at any time through cookie preferences or by contacting us.
We retain PI only for as long as reasonably necessary to achieve the purposes described in this Policy, including to meet legal, tax, and accounting obligations, to resolve disputes, and to enforce agreements. Retention periods vary by data category and purpose. When PI is no longer needed, we will delete or de‑identify it consistent with applicable law.
We implement organizational, technical, and physical safeguards appropriate to the sensitivity of the PI we process, including access controls, encryption in transit where applicable, secure development practices, and employee training. No method is 100% secure, and we cannot guarantee absolute security.
Our services are intended for adults. We do not knowingly collect PI from children under 13 (or the relevant age in your jurisdiction). If you believe a child provided PI to us, please contact us and we will promptly take appropriate steps to delete such information.
If you access our site from outside the United States, be aware that your information may be processed in the U.S. and other countries with different data protection laws. Where required, we use appropriate safeguards for cross‑border transfers.
Depending on your location, you may have rights to access, correct, delete, receive a copy (portability) of your PI, restrict or object to certain processing, opt out of targeted advertising/ sharing, and limit or withdraw consent. To exercise rights, contact privacy@ezbackyard.com or call (858) 630-6767. We may verify your identity before fulfilling requests. Authorized agents may submit requests with valid proof of authorization and identity verification.
We will not discriminate against you for exercising privacy rights, except as permitted by law (for example, where a price difference is reasonably related to your data’s value in a loyalty program that you choose to join).
We may update this Privacy Policy from time to time. The “Last updated” date will be revised accordingly. Material changes will be announced via our website notices or direct communications when appropriate. Continued use of our services after changes means you acknowledge the updates.
These Terms of Service (the “Terms”) govern your access to and use of EZ Backyard websites, quote and scheduling tools, professional installation services, and related support (collectively, the “Services”). By visiting our site, submitting a quote request, or engaging our installers, you agree to these Terms. If you do not agree, do not use the Services.
You must be at least the age of majority in your jurisdiction and authorized to contract for the property where installation will occur. By ordering Services, you represent that you have full authority to permit site access and to perform the work.
Our Services include professional installation for outdoor living products purchased from us or third parties, which may involve: site preparation, delivery coordination, assembly, electrical and plumbing hookups by appropriately licensed trades, testing, and cleanup. Unless expressly stated, structural engineering, architectural drawings, permit fees, and utility upgrades are excluded.
Quotes are prepared from information you provide and are valid for the period shown. Final pricing may change after on‑site assessment or discovery of concealed conditions (e.g., subsurface issues, code deficiencies, insufficient electrical capacity). Any change in scope, materials, or schedule requires your approval via written change order and may affect cost and timing.
We will coordinate a mutually agreeable installation date. You are responsible for ensuring safe, unobstructed access; confirming underground utilities/clearances; securing pets; and preparing the site (e.g., level pad, adequate drainage, clear pathways). If we arrive and the site is not ready, we may charge a reasonable rescheduling or standby fee.
Unless your agreement states otherwise, you are responsible for permits and inspections. Where we assist, we act as your agent solely for permit submission and may charge administrative fees. We perform work in accordance with applicable codes and manufacturer specifications.
When you provide products (DIY purchases), you warrant they are suitable, complete, and undamaged. We are not responsible for third‑party defects, shipping delays, or missing parts. Labor or materials required to adapt customer‑supplied items will be billed as additional Services.
Deposits may be required to reserve scheduling and procure materials. Progress and final payments are due as stated in your agreement. Late balances may accrue fees and collection costs. Financing, if offered, is provided by third‑party lenders under their terms; approval is not guaranteed.
Risk of loss for customer‑provided goods remains with you. We take reasonable precautions to protect surfaces and landscaping, but incidental wear from normal installation activity may occur. Please remove fragile items from the work area before installation.
We warrant our workmanship as described in the Installation Warranty section. Manufacturer warranties apply to products and components. We may assist with warranty coordination as a courtesy but are not responsible for manufacturer determinations.
We follow safety protocols and may stop work if conditions are unsafe, including hazardous weather, unstable structures, or aggressive animals. You agree to maintain a safe site and to follow reasonable instructions from our crew.
With your consent, we may capture non‑sensitive photos or short videos of the completed project for quality records and marketing. You may withdraw consent for future marketing use by contacting us.
EXCEPT AS EXPRESSLY PROVIDED, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL IMPLIED WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON‑INFRINGEMENT.
TO THE FULLEST EXTENT PERMITTED BY LAW, EZ BACKYARD, ITS AFFILIATES, AND PERSONNEL WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR LOST PROFITS, ARISING FROM OR RELATED TO THE SERVICES, EVEN IF ADVISED OF THE POSSIBILITY. OUR AGGREGATE LIABILITY WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE SPECIFIC SERVICES GIVING RISE TO THE CLAIM.
You agree to defend, indemnify, and hold harmless EZ Backyard from third‑party claims arising out of your breach of these Terms, your negligence, or your misuse of the Services.
We are not liable for delays or failures caused by events beyond reasonable control, including severe weather, supply chain disruptions, labor shortages, pandemics, or governmental actions.
These Terms are governed by the laws of the state where the project is performed, without regard to conflicts rules. Before filing suit, the parties will attempt to resolve disputes in good faith. If unresolved, claims may be brought in the state or federal courts located in that state, and the parties consent to jurisdiction there. CLASS ACTIONS ARE WAIVED TO THE FULLEST EXTENT PERMITTED BY LAW.
If any provision is unenforceable, the remainder remains in effect. Your written service agreement, these Terms, and any change orders constitute the entire agreement. We may update these Terms by posting a revised version; continued use constitutes acceptance.
